Department of Public Safety Towing Safety Agreements Amendment

TSA holders:

On March 30th, to address the ongoing Coronavirus (COVID-19) outbreak, the TSA has been amended to maintain business operations that accommodate the social distancing methods recommended by the Centers for Disease Control (CDC).  Paragraph 29.9 under Vehicle Storage Facility Specifications has been added to state:

“29.9 Notwithstanding Paragraph 29.8 under Vehicle Storage Facility Specifications, the Towing firm may elect to service the tow yard vehicle access/claims process through appointment. Vehicle owner/owner's agents may schedule appointments by phone for immediate access and service shall begin within 30 minutes after the tow company receives phone notification. This is to accommodate customers who may arrive at storage yard without knowledge of any requirement for phone appointment and to have service provided within 30 minutes of their arrival. After hours service will not be billed if the appointment is made within normal business hours. Any person or person’s vehicle owner or vehicle’s agent requesting service, while tow personnel are on property, shall be serviced in the same manner as prescribed in the TSA paragraph 29.8. No phone call is deemed necessary if tow personnel is on premises.”

The amendment was originally instated to be effective until midnight April 21st, 2020. To keep in compliance with the State's guidelines on social distancing and business practice methods, the aforementioned TSA amendment is extended to May 31st, 2020 unless the State's health guidelines change where an earlier termination of the amendment is appropriate.

Continue to act in the effort to prevent scheduling conflicts/frustrations. Tow drivers shall communicate, when appropriate and possible, to the vehicle owner/owner’s agent at time of tow service that vehicle storage facilities may not be physically staffed during business hours and phone appointments are required for vehicle access. Accessibility fees shall not be charged if within minimum TSA business hours.

This amendment extension is effective immediately and expires May 31st, 2020. This amendment shall become void at midnight May 31st, 2020 and the agreement shall revert to original language and requirements in full.
